All clients must read and agree with these terms of service. By commissioning Chimera Sparks you agree with the terms, not reading them will not exclude you from agreeing and abiding the terms of service.

General

I have the right to decline any request. I normally do not work with a deadline, this is not my fulltime job. I try to finish every commission in a reasonable time and do not take new commissions when I can not finish them. If you do want me to work with a deadline, please let me know so I can see what I’m able to do.

Age Requirement

You must be 18 years or older to commission Chimera Sparks. I might need any form of age confirmation. Under aged buyers must a parent or guardian commissioning me on their behalf. If you are a minor and want to commission us you have to get your parents or guardian to contact us on your behalf before sending anything else.

Allergy Warnings

I have a long haired Chihuahua and every now and then a King Charles Spaniel in my house. The Chihuahua is in my workspace with me. If you have an allergy please keep this in mind!

Quotes

Quotes do not guarantee you a commission slot and do not hold or bind you in a commission slot agreement. A quote is a price estimate bases on complexity of the design, materials required and additional features. To get a more accurate quote you need a 2 – 3 view concept (not for general plushies or probs) or a kigurumi reference sheet. Quotes do not include shipping and prices may change between commissions.
When going for a final quote (this is not for general plushies or probs) you will need a digital reference sheet or kigurumi reference sheet, with a kigurumi reference sheet your markings can be placed on the spot you want with more accuracy. Proof you have read my TOS. Proof that you own the character.

Payments

After receiving a final quote and accepting with the price a 30% non-refundable down payment is required within a week of acceptance. The deposit is used to order materials for your commission. Payment is done via PayPal and is in EURO or bank transfer if you live in Europe. PayPal automatically converts payments from your local currency to EURO. All payments are to be made via invoice.
I will add your commission to the queue that can be found here. To start on the commission 70% of the price must be paid. The remaining 30% and shipping must be paid upon completion. Items will not be shipped until they are fully paid for. It is also possible to pay the full price when the commission is accepted or to pay 50% when the commission is accepted and 50% before the start.

Warranty/Returns

Everything comes with a 60 day warranty from the day it’s sent out. If you find any defect in the construction contact us immediately. Any mistreatment to the items such as (but not limited to) improper storage, cleaning, unauthorized edits, smoke and/or water damage will void the warranty. If anything is send in for repair and is dirty, smelly or shows signs of mistreatment without any claims of damage during shipping the warranty will be void. The warranty does not include damage caused by shipping. In case of shipping damage, keep ALL shipping materials and contact me immediately. Photos of the damage need to be provided and we can contact the postal service to make a claim about the damage.

Cancellation/Alteration

We reserve the right to cancel a commission for any reason with a full 100% refund. We can cancel the commission because of a problem on the client side like a client being rude, threatening or unreasonable. If this happens the refund will depend on the progress made, we can send the unfinished project to the client this will change the amount of refunded money. Once the project starts and fabrics are ordered changes in the design can not be made unless very small and without the need to order new material.
When the client cancels the commission at any point of time the refund will be calculated on the current progress. There always is a 30% that is non-refundable for the material costs. It is possible to send the unfinished product to the client, this will influence the refund. When the product is nearly finished and the customer does not want to keep it, we have the rights to change the design and sell the item.
Minor alterations can only be made when no new materials are needed and are possible. If you need anything altered during the process always let me know as soon as possible. Keep in mind that major alterations or alterations at a late stage may result into extra fees. When alterations need to be made because a mistake on my side no extra fees will be added.

Refund Policy

There is no refund on the non-refundable 30% deposit. After completion of the product there is no option for a refund. If the commission is canceled while the product is not yet completed the refund depends on how far the product is. You can choose to get a refund and the product in its current incomplete state or you get a refund and I will have the rights to change the design and sell the product. The option you choose will influence the amount you get refunded, if you want to keep the unfinished product you will get a lower refund. Shipping costs and other fees are yours to pay. Forced refunds or demanding a certain amount of money will result in little to no refund, a blacklist and possibly a public beware.

Shipping

Shipping is NOT included into the price. The client is responsible for all shipping costs and fees. International customers must pay all customs fees and/or taxes. These fees tend to be expensive and vary by country. Please do your research and contact your local postal service to determine the fees you might need to pay before commissioning me. I will not mark packages as a “gift” to avoid fees. I am located in Limburg, Netherlands. At convention delivery or local pickup might be arranged. Chimera Sparks is NOT responsible for any lost or damaged packages, we will however do our best to work with you and find any missing packages.

Measurements

To make a kigurumi we require some measurements. Make sure that these are as accurate as possible. Kigurumi are meant to be baggy and big unless otherwise requested by the client. We are not responsible for poor sizing on your side, use a tape measure or something like that DO NOT use ruler or metal tape measure. Let us know when you have any special measurements we should take note of.

Copyrighted Characters

Chimera Sparks does not make any characters under copyright. This includes but is not limited to: Pokémon, Disney, Pixar, etc.

Style

By commissioning us you acknowledge that we have our own style. When commissioning a kigurumi with a standard 2 – 3 view reference sheet you accept the artistic freedom in the placing of your characters markings on the kigurumi. If you want to decide the exact placement of your characters markings on a kigurumi you have to send in a kigurumi reference sheet.
I am willing to make edits during the process if the edits are possible, it is important that as soon as you notice any issues you are required to let me know. Remember that fleece is not as good at hiding fabric seams than faux fur or other materials.

Fabric Color Availability

Fabric colors are limited. While we always try to find fabrics that match the concept art as close as possible. Before start we will send pictures of the fabric before starting the project. Keep in mind that the fabrics will not always 100% match the color on the concepts art. Once you agree on the fabrics when the picture is send you understand the following: we do not provide refunds or alterations due to the color variation in the fabrics.

Work in Progress

During the production we will send some work in progress pictures, however if the client wishes to see the current progress we will send a work in progress picture as soon as possible. Most of the time work in progress pictures will be send when cutting fabrics and during sewing, we will try to send pictures regularly. When you see something in the work in progress pictures that looks off or wrong please let us know as soon as possible so we can still change it.

Media Usages

All rights to the character remain to be property of the client. We have the rights to post pictures of the finished product on our website or social media.

Liability

Chimera Sparks is not responsible for any injury that comes from our work. This includes (and is not limited to) falling, heatstroke, tripping, etc. It is your job to know your limitations.
